The newly revised edition with all the April 2014 updates from CMS contains significant revisions to Chapter 7 of the State Operations Manual addressing the Survey and Enforcement Process for skilled nursing facilities and nursing facilities. This covers Medicare and Medicaid guidance regarding the imposition and collection of civil money penalties by CMS when nursing homes are not in compliance with federal participation requirements in accordance with section 6111 of the Affordable Care Act of 2010. Many of the changes involve the informal dispute resolution process, reduction of CMPs for self-reporting and prompt correction of noncompliance, payment of CMPs (including escrow account details), and use of CMP funds. There are also revisions to the exhibits.
The Long Term Care Enforcement Procedures manual is an essential guide to keeping your facility compliant. Knowledge of CMS enforcement remedies is critical for survey preparation.
